Pet to sell land in Carroll County Court
Be it remembered that this day came on this cause to be & was heard before his Honor G W Humble Judge & C upon the report of E Falkeven Clerk of the County Court of Carroll County Tenn Said report being in the words & figures as follows

 Pet to sell land in the County Court of Carroll Co. Tenn. To the Honl. G W humble Judge & C of said County Court
Your undersigned Commissioner to sell the land in the above styled cause begs leave to make the following report of his proceedings in the cause.
In obedience to a decree pronounce at the December term 1878 of said Court & after advertizeing as by said decree directed did on Saturday January 4" 1879 in the town of Hollow Rock Carroll County expose to public sale said land when N B Lipe became the purchaser of the following tracts to wit  First tract lying in Carroll County Tenn & bounded as follows 'towit' Begining at the south west Corner of a two Hundred acre tract Known as the Wells tract running west 24 poles to Stokers tract and Corner on the NW Corner of 144 acre tract granted in the name of Wm Mitchell thence North to Robt Strokers Corner on the big branch thence East with the branch and corner on a 200 acre tract granted in the name of Thos. R Adams Containing 18 acres & 132 poles & one other tract ad-joining the above bounded as follows  Begining on Grooms East boundary thence east 200 poles to a tract of land entered in the name of James Yee thence North 26 7/8 poles & corners on Yees land west boundary line Thence west and corners on big branch thence with the branch and Corners on the Grooms tract Containing 58 acres 53 1/2 said two tracts Containing 76 acres were sold to said N B Lipe at the price $4 85  per acre aggregating the sum of $368.60 & at said sale N B Lipe became the purchaser of on other tract bounded as follows towit.  Begining on the North east Corner of Moses Auvenshine homestead tract & runs East with said line 122 1/2 poles to a stake thence south 215 poles thence west 73 1/2 poles to a stake thence North 115 poles to a stake thence west 47 poles to a stake with pointers thence north 100 poles to the begining Containing 130 acres more or less which said tractsold at the price of $1.25 pr acre aggregating the sum of $162 .50 makeing the total aggregate of

 N B Lipe purchase $531.10 would futher report that the said Lipe paid in cash $53.10 and Executed his two promisory notes for $238.99 each due respectively 12 & 24 Months from day of sale with  as his surety thereon would futher report that at said sale  Wm H Groom became the purchaser of the following described tract Known as the Stokers tract being the North end of a tract Entered in the name of Robert Stroker for 240 acres and bounded as fol-lows Begining on a stake small hickory pointers a North west Corner of Wm Stroker and runs north 70 poles to a stake post oak pointers thence east 39 poles to a White oak pointers W H Groom corner thence east with Grooms South boundary 153 poles to a stake White oak pointers thence South 130 poles to a stake Chestnut & other pointers thence West 192 poles to the begining Contain-ing 140 acres more or less from which tract 140 acres 20 acres & 13 poles were sold during the lifetime of Moses Auvenshine & bounded as follows  Begining on a black oak the North West corner of said entry running east 153 poles to a stake with White oak pointers thence South 21 poles to a stake beech & Chest-nut pointers thence West 153 poles to a stake red oak pointers thence North 21 poles to the begining. Leaving 120 acres which was purchased by said Groom at the price of $2.05 pr acre aggregating the sum of $246 oo would futher report that said Grooom paid in cash the sum of $24 60  and Executed his two promi-sory notes due respectively 12 & 24 months from day of sale for $110 70 Each with J C Bilberry & J A Groom as his sureties thereon would futher report that at said sale one Jesse Turner became the purchaser of the following described tract of land bounded as follows  Begining on a Maple with pointers Thence west 66 poles to a stake thence North 64 poles to a stake thence west 50 poles to a stake near where an old School House did stand on the Marlborro Mans-field road Thence North 107 1/2 poles to a small black oak with pointers Thence east 94 poles to a black oak with pointers Thence South 8 poles to a stake post oak 7 blk oak pointers Thence East 21 poles to a stake Thence south 163 1/2 poles to the begining Containing 103 acres more or less at the price of $1.11 pr acre aggregating the sum of $114.33 would futher report that said Jesse Turner paid in cash the sum of $11.45 & executed his two promisory notes due respectively 12 & 24 months from day of sale for $57.45 each

with W J Turner & J A Turner as his sureties thereon  Would futher report that at said sale Wm Auvenshine became the purchaser of the following described tract of land lying in Benton County Tenn 10th Civil Dist & Bounded as fol-lows, Begining at a stake with red oak pointers the North East Corner of a one hundred & ninety acre tract granted to F L Surratt & runs East 108 5/6 poles with it East boundary to a small spanish oak with small spanish oak & dog-wood pointers East 147 poles to a dogwood  with hickory spanish oak & dog-wood pts on the west boundary of said 192 acre tract north with the same 108 5/6 poles to a stake the N W Corner of the same thence east with the north boundary 147 poles to the begining 100 acres more or less said land was sold to Wm Auvenshine at the price of $2.80 pr acre aggregating the sum of Two Hundred & Eighty Dollars     Would futher report that the said Wm Auvenshine has paid in cash $110oo but has failed up to this date to Execute his notes for the balance of the purchase money.

And said report being unegeipted to is in all things confirmed  Its therefore or-dered and decreed by the Court that all the right title and interest of the peti-tioners & defendants in this cause as the Children & heirs at law of Moses Au-venshine decd to the lands mentioned in the pleadings in this cause be & the same is hereby divested out of them & vested in the parties purchasers respec-tively Except as to the tract purchased by Wm Auvenshine he having failed to comply with the terms of the sale & that the Clerk retain a lien on said land for the payment of the purchase money
On motion and it appearing to the satisfaction of the Court that Wm Auven-shine was at the March term of the County Court 1875 appointed Guardian for Nancy M. Martha J. Gatsey A. Armanda & Moses Auvenshine and it appearing to the satisfaction of the Court that he has never made settlement or renewed his bond as required by Section 2499 of the Code of Transfer   It is therefore ordered by the Court that the said William Auvenshine be & he is hereby re-moved as such Guardian & that he deliver up the assets in his hands if any to his successor
